Job Applicant Privacy Notice - SeaBird Exploration Group
During the recruitment process, the company collects and processes personal data relating to job applicants. The company is committed to being transparent about how it collects and uses that data and to adhering the data protection obligations in accordance with the European General Data Protection Regulation (“GDPR”).

 

What information we collect:
1. The company collects a range of information about you, including:
- your name, address, contact details, including email address and telephone number;
- details of your qualifications, skills, experience and employment history;
- information about your current level of remuneration, including benefit entitlements;
- whether or not you have a disability for which the company needs to make reasonable adjustments during the recruitment process.

2. You are under no statutory or contractual obligation to provide this information to the company during the recruitment process. However, if you do not provide the information, we may not be able to process your application properly or at all.

 
How we collect the information:
3. Data might be contained in application forms, CVs or resumes, obtained from your passport or other identity documents, or collected through interviews or other forms of assessment. We may also collect personal data about you from third parties, such as references supplied by former employers.

4. We will seek information from third parties only once a job offer to you has been made and will inform you that we are doing so.

Where we store the information:
5. Information will be stored in a range of different places, including on the application record, in HR management systems and on other IT systems (including email).

Why are this information processed:
6. We need to process data in preparation for entering into a potential contract with you. In some cases, we need to process data to ensure that we are complying with our legal obligations.

7. The company has a legitimate interest in processing personal data during the recruitment process and for keeping records of the process. Processing data from job applicants allows us to manage the recruitment process, assess and confirm a candidate's suitability for employment.

8. The company may process special categories of data, such as information about ethnic origin, sexual orientation or religion or belief, to monitor recruitment statistics. We may also collect information about whether or not applicants are disabled to make reasonable adjustments for candidates who have a disability. We process such information to carry out our obligations and exercise specific rights in relation to employment. We will always obtain your explicit consent to those activities unless this is not required by law or the information is required to protect your health in an emergency. Where we are processing data based on your consent, you have the right to withdraw that consent at any time.

Who can access the data:
9. Your information may be shared internally for the purposes of the recruitment process including to members of the HR and recruitment team, interviewers, managers in the business area with a vacancy and IT staff if access to the data is necessary for the performance of their duties.

10. We will not share your data with third parties, unless we make you an offer of employment. We will then potentially share your data with former employers to obtain references for you, employment background check providers to obtain necessary background checks.

Protection of data
11. We have internal policies and controls in place to ensure that your data is not lost, accidentally destroyed, misused or disclosed, and is not accessed except by our employees in the proper performance of their duties.

How long we keep the data:
12. If your application for employment is unsuccessful, the company will hold your data on file after the end of the relevant recruitment process on the condition that you agree to allow us to keep your personal data on file for consideration for future employment opportunities. Once you withdraw your consent, your data is deleted or destroyed.

Your rights:
13. Under GDPR you have a number of rights with regard to your personal data. You have the right to request from us access to and rectification or erasure of your personal data, the right to restrict processing, object to processing as well as in certain circumstances the right to data portability.

14. In any circumstances where you may have provided your consent to the collection, processing and transfer of your personal information for a specific purpose, you have the right to withdraw your consent for that specific processing at any time. Once we have received notification that you have withdrawn your consent, we will no longer process your information for the purpose or purposes you originally agreed to, unless we have another legitimate basis for doing so in law.

15. You have the right to lodge a complaint to the Data Protection Commissioner if you believe that we have not complied with the requirements of the GDPR with regard to your personal data.
